The MTP Act: a gestation limit that depends on who is asking

The Medical Termination of Pregnancy (MTP) Act, 1971, legalised abortion in India under specified conditions, and its 2021 Amendment significantly extended access by raising the gestation limit at which termination is permitted for defined special categories of women (including survivors of rape and incest, and other vulnerable categories such as minors or differently-abled women) from 20 weeks to 24 weeks. The amendment also changed the medical-opinion requirement along the same lines: termination up to 20 weeks of gestation requires the opinion of only one registered medical practitioner, while termination between 20 and 24 weeks requires the opinion of two, a genuinely graduated requirement that scales with how far the pregnancy has progressed rather than a single fixed threshold applying uniformly.

The PCPNDT Act: banning sex determination, not prenatal diagnosis itself

The Pre-Conception and Pre-Natal Diagnostic Techniques (PCPNDT) Act, 1994, is worth stating precisely rather than as a blanket ban on prenatal testing: its actual target is sex selection and sex determination, before or after conception, specifically to prevent the technology being misused to enable female foeticide, not prenatal diagnostic technique as such, which remains legal and regulated when used for its legitimate purpose of detecting genuine genetic abnormalities, metabolic disorders, chromosomal abnormalities or congenital malformations. Every genetic counselling centre, genetic laboratory or genetic clinic offering any technique with the technical potential for sex selection, explicitly including techniques used in the course of IVF such as pre-implantation genetic diagnosis, falls under the Act's regulatory purview specifically because of that potential for misuse, regardless of the clinic's own stated primary purpose.

Assisted reproductive technology: distinguishing IVF, ZIFT and GIFT

Three named assisted-reproduction techniques are frequently confused with one another, and the exact point at which each returns material to the woman's body is the specific detail that separates them. In vitro fertilisation (IVF), popularly called the "test-tube baby" technique, fertilises an egg and sperm entirely outside the body under laboratory conditions, and it is only the resulting embryo, after some initial cell division, that is then transferred into the uterus. ZIFT (zygote intrafallopian transfer) also fertilises the egg outside the body in the laboratory, exactly as IVF does, but transfers the resulting zygote back into the body at a considerably earlier stage, directly into the fallopian tube rather than the uterus, before any cell division has begun. GIFT (gamete intrafallopian transfer) goes a step further back still: unfertilised eggs and sperm (gametes) are placed together directly into the fallopian tube, and fertilisation itself then happens naturally, inside the woman's own body, rather than in the laboratory at all, the single clearest distinguishing feature separating GIFT from both IVF and ZIFT.
